Terms of Service

MAXOUT publishes statistical models, projections, and analysis of professional sports outcomes. At launch the Service covers MLB pitcher strikeouts, NFL quarterback passing yards, and NBA three-pointers made, and we add sports, statistics, and modules over time. The Service is informational and for entertainment. It is not gambling, and we are not a sportsbook, casino, or gambling operator. We do not accept, place, or facilitate wagers, hold gambling funds, or pay out winnings.

Nothing on the Service is betting advice, financial advice, or a recommendation to place any wager. Projections are model outputs. Estimates built from historical data and simulation. They are frequently wrong. Any past results we publish, including the calibration ledger that compares each projection to the actual outcome, describe past performance only; past performance does not predict future results. You are solely responsible for any decision you make, including any wager you place with a third party, and for complying with the gambling laws of your jurisdiction. Sports wagering is illegal in some jurisdictions, and it is your responsibility to know whether it is legal in yours.

You must be at least 21 years old to use the Service. By using the Service you represent that you are 21 or older and that using the Service is lawful where you live. We may require proof of age and may terminate any account we reasonably believe belongs to someone under 21.

You create your account directly on MAXOUT with an email address and password. Paid access is billed through Stripe, our payment processor; your subscription status controls your access to Advanced features. You are responsible for your account credentials and for all activity under your account. One account per person; sharing login credentials or Advanced content access with others is prohibited.

Current plans: MAXOUT Advanced at $19.99 per month, or $149.99 per year (an annual subscription covering twelve months of Advanced access across every sport module). A single MAXOUT Advanced subscription includes every sport module we offer under Advanced, including modules we add later, at no additional charge. Prices may change for new subscribers at any time.

We may launch a new sport module in a free preview period before it becomes part of paid Advanced. Preview features are free while in preview, may change, and may become paid on notice.

Plans renew automatically until canceled. Because they auto-renew, the renewal price, billing frequency, and cancellation method are disclosed at checkout, and you consent to automatic renewal when you subscribe. Applicable taxes are additional where required. Charges appear as “MAXOUT PROPS” on your card statement.

Cancel anytime from your Account page (via the Stripe billing portal). Cancellation stops future renewals; you keep Advanced access through the end of the period you already paid for. We do not issue refunds or credits for partial months, partial years, or unused time. If we materially fail to deliver the Service for an extended period, contact us at support@maxoutprops.com and we will make it right at our discretion.

We grant you a personal, non-exclusive, non-transferable license to use the Service and its content for your own non-commercial use. You may not: (a) copy, republish, sell, or redistribute Service content or data, including CSV exports, projections, edges, percentiles, or ladder probabilities, whether free or paid; (b) scrape, crawl, or access the Service by automated means; (c) use the Service to build or train a competing product, model, or dataset; (d) circumvent the paywall, entitlement checks, or any technical restriction; or (e) frame or mirror any part of the Service. CSV export is provided for your personal analysis only.

The Service, including the MAXOUT name and marks, the module names, the site design, the models, and all content we publish, is owned by BES3 Enterprises, LLC or its licensors and protected by intellectual-property law. These Terms transfer no ownership to you. Underlying sports statistics and facts are drawn from third-party sources; our compilations, projections, and presentation are ours.

MAXOUT is not affiliated with, endorsed by, or licensed by Major League Baseball, the National Football League, the National Basketball Association, any of their member clubs, the Major League Baseball Players Association, the National Football League Players Association, the National Basketball Players Association, or any sportsbook. League, team, and player names and statistics are used for identification and analysis only. Stripe processes all payments under its own terms and privacy policy; we do not store your payment card details.

We aim for reliable publishing on each module’s schedule but do not promise uninterrupted or error-free operation. Data feeds fail, games get postponed, and models get revised. We may modify, suspend, or discontinue any feature, module, or sport at any time. If we discontinue paid service entirely mid-period, we will refund the prorated remainder of prepaid, unused time: this is the only proration exception to Section 5.

If gambling has stopped being entertainment for you, stop, and use the self-exclusion tools your sportsbook and state provide.

The Service is provided as is and as available, without warranties of any kind, express or implied, including accuracy, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that projections, edges, odds references, or any other data are accurate, current, or complete, or that using the Service will produce any particular result, including wagering profit.

To the fullest extent permitted by law, BES3 Enterprises, LLC and its members, managers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits or gambling losses, arising from or relating to the Service, even if advised of the possibility. Our total aggregate liability for all claims will not exceed the amounts you paid us in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations; in those jurisdictions our liability is limited to the fullest extent the law permits.

You will indemnify and hold harmless BES3 Enterprises, LLC from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the Service, or your violation of law, including gambling laws.

These Terms are governed by the laws of Virginia, without regard to conflict-of-laws rules.

Any dispute arising out of these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You and MAXOUT waive any right to a jury trial and to participate in a class action. Either party may instead bring an individual claim in small-claims court. You may opt out of this arbitration provision by emailing support@maxoutprops.com within 30 days of first accepting these Terms.

We may suspend or terminate your access for breach of these Terms, including scraping, redistribution, or paywall circumvention, without refund. Sections 7 and 11 through 14 survive termination.

We may update these Terms. Material changes will be posted on the Site with a new effective date, and continued use after the effective date is acceptance. For paid members we will give notice by email at least 14 days before material changes take effect.
